What Florida Law Requires in a Parenting Plan

Florida Statute §61.13 requires a written, court-approved parenting plan in every divorce or paternity case involving minor children. Under §61.046(14), the parenting plan is the governing document for decisions affecting a minor child. It isn’t optional, and a plan that omits required elements can be sent back to the trial court to add what’s missing.

At minimum, a valid parenting plan must cover:

  • Daily responsibilities: How parents share the tasks involved in raising the child day to day
  • Time-sharing schedule: The specific times the child spends with each parent, including holidays and overnights
  • Healthcare and school decisions: Which parent is responsible for healthcare choices, and which address is used for school-boundary registration
  • Communication methods: How each parent will communicate with the child, including the technologies permitted

Getting these designations right from the start can help prevent future disputes over what the plan actually requires. Ambiguity tends to surface at the worst possible moments.
