COMMON QUESTIONS  (Please see our PI
page for Personal Injury claims)
WHAT IS THE DIFFERENCE BETWEEN A  DIVORCE AND AN
ANNULMENT?

A divorce is a breakdown in a valid marital relationship
justifying  a judicial determination and judgment returning the
parties to single status.
An annulment is a judicial determination that a valid marriage

never
took place.

WHAT DOES THE COURT LOOK AT WHEN MAKING A CUSTODY
DETERMINATION?

The Child Custody Act authorizes a trial court to modify child
custody "for proper cause shown" or because of "change in
circumstances"
and if in the child's best interests.

IF I TERMINATE MY PARENTAL RIGHTS AM I STILL OBLIGATED TO
PAY CHILD SUPPORT?

Typically the obligation to support a child ends when the parental
rights are terminated or adopted, however, the termination of one's
parental rights does not necessarily terminate a biological parent's
child support obligation.
Evink v. Evink, 214 Mich. App. 172 (1995).

WHO MAY BRING A PATERNITY SUIT?

Actions under the Paternity Act may be brought by the mother; the
father, a child who became 18 years old after August 15, 1984, and
before June 2, 1986; or in certain circumstances.  A support order
arising from a divorce decree constitutes an adjudication of
paternity  and establishes the duty of support.

WHO MAY PETITION FOR GUARDIANSHIP?

Any person interested in the welfare of the minor(s), or a minor 14
years of age or older, may petition for the appointment of a guardian
of the minor.
